Wayne J. Positan To Be Installed As President Of The New Jersey State Bar Association

NEW BRUNSWICK, NJ — Attorney Wayne J. Positan, Managing Director of the Roseland, NJ law firm of Lum, Danzis, Drasco & Positan LLC, and a resident of Essex Fells, will take the oath of office as the 108th President of the New Jersey State Bar Association on May 18 at the organization’s annual meeting in Atlantic City.

As President, Mr. Positan is responsible for heading the association’s Board of Trustees, serving as the association’s official spokesperson and meeting with officials from state government and county bar associations to discuss issues of mutual concern. In addition to these duties, he continues in his role as a trustee for the New Jersey State Bar Foundation, the NJSBA’s philanthropic arm.

Mr. Positan heads the Labor, Employment and Government Group at Lum Danzis. He represents management and defendants in such matters, including non-compete litigation.

Mr. Positan has been a member of the NJSBA for thirty-two years and has served on its Board of Trustees since 1998. He is the Third District Nominee to the ABA Board of Governors, representing New Jersey and Pennsylvania. A member of the ABA House of Delegates, Mr. Positan served as the Chair of the ABA Commission on Multijurisdictional Practice from 2000-2002 which culminated in the adoption of changes to the Model Rules of Professional Conduct concerning various issues on the multi-state practice of law, licensure, and disciplinary matters. That report has been published by the ABA titled “Client Representation In The 21st Century.” He had previously chaired the NJSBA Committee on Multijurisdictional Practice.

Mr. Positan has spoken before the Conference of Chief Justices and numerous other organizations and programs around the country on the subject, and moderated the ABA Connection National Teleconferences on “Ethics Issues in Multijurisdictional Practice” and “The Final Word on Ethics 2000.”

Mr. Positan chaired the NJSBA Labor and Employment Section (1995-1997) and has served on its Executive Committee since 1987. He has chaired the Annual Institute for Legal Education Labor Law Forum/Bench Bar Conference since 1994. He has served in the leadership of the ABA Section of Litigation as Director of Divisions, a member of its governing Council, Co-Chair of the Employment and Labor Relations Committee, Co-Chair of the Task Force on the Merit Selection of Judges, Co-Chair of the Section Annual Meeting, a member of the Section Task Force on Hurricane Katrina, Liaison to ABA Day in Washington, and Co-Chair of the Fellows of the Section of Litigation. He is Editor-In-Chief of the ICLE book New Jersey Labor and Employment Law (2nd Edition 2005). He has also served on the Board of Editors of the ABA book Jury Instructions in Employment Litigation and as a contributing author to the ABA books Business Torts Litigation and Employment Litigation Handbook.

The Essex County Bar Association honored Mr. Positan with its Professional Achievement Award in 2001. The New Jersey Commission on Professionalism in the Law bestowed a Professional Lawyer of the Year Award to him in 2002. He received the Humanitarian and Achievement Award from the Columbian Foundation in 2002.

Mr. Positan was elected a Fellow of the College of Labor and Employment Lawyers as a member of its inaugural class of 100 lawyers nationally in 1996, was elected a Fellow of the American Bar Foundation and a Fellow of the ABA Section of Litigation.

Mr. Positan was selected by his peers as one of the “Best Lawyers in America” for labor and employment law, having been so listed for over 13 years; was named one of the “Top 100” Superlawyers in New Jersey Monthly magazine (May 2005), and as a Superlawyer for employment litigation; has been selected as one of the Best Lawyers in the New York Area (New York Magazine, August, 2005 and July, 2006); was featured in New Jersey Monthly magazine “Top Lawyers” (March 2003); was selected as one of the “Top Eight “ NJ Employment Defense Lawyers in Chambers USA’s “America’s Leading Business Lawyers” (2003-2005); and is listed in Who’s Who In American Law, Who’s Who In America, Who’s Who In The World and the International Who’s Who of Management Labor and Employment Lawyers.

Mr. Positan serves on the Board of Trustees of Montclair State University where he chairs its Personnel Committee. He also serves as Vice Conseiller Gastronomique of the international wine and food society, La Confrerie de la Chaine des Rotisseurs, Saddle River Valley chapter; on the Board of Directors of Marotta Controls, Inc. and the Professional Group Advisory Council of Valley National Bank; and is a member of the Boston University Friends of Hockey. Mr. Positan is a Silver Council Member of the National Italian American Foundation and a member of the Columbian Foundation.

Mr. Positan is a magna cum laude graduate of Boston University with a B.A. in government, and received his law degree from New York University School of Law.
