Wayne J. Positan Named First Vice President Of New Jersey State Bar Association

NEW BRUNSWICK, NJ – Wayne J. Positan, Managing Director of the Roseland law firm of Lum, Danzis, Drasco & Positan, LLC, and Essex Fells resident, was installed as first vice president of the New Jersey State Bar Association on May 20 at the organization’s annual meeting in Atlantic City.

Positan is immediate past chair of the NJSBA’s Long-Term Planning Committee and previously served on the Finance and Operations, Elections, and Meeting and Program Arrangements Committees of the NJSBA. He also serves as trustee for the New Jersey State Bar Foundation, the NJSBA’s philanthropic arm.

Positan has been a member of the NJSBA for 29 years and has served on the Board of Trustees since 1998. He served as chair of the association’s Committee on Multi-Jurisdictional Practice (MJP), a highly charged issue regarding cross-border practice, until his appointment to the American Bar Association (ABA) Commission on MJP in 2001.

In that capacity, Positan appeared before the Conference of Chief Justices at its January 2001 mid-year meeting to speak on that issue. He conducted numerous commission hearings around the country and testified on MJP before the New Jersey Supreme Court Ad Hoc Committee on Bar Admissions in March 2002. Positan served as a moderator and panelist on the ABA Connection and National Teleconferences on “Ethics Issues in Multi-Jurisdictional Practice” in February, 2002, and “The Final Word on Ethics 2000” in December, 2002. On August 12, 2002, the ABA House of Delegates approved the commission’s report in full in nationally televised proceedings on C-Span.

Positan is an Executive Committee member of the NJSBA Labor and Employment Law Section where he served as chair from 1995 to 1997. Since 1994, Positan has served as chair of the Institute for Continuing Legal Education (ICLE) Labor Law Forum and Bench Bar Conference, an annual event cosponsored by the Labor and Employment Law Section. He is also editor-in-chief of the ICLE book, “New Jersey Labor and Employment Law.”

In addition to chairing the ABA MJP Commission, Positan served in the ABA Section of Litigation leadership since 1990 as Director of Divisions, a member of the governing Council, co-chair of the Task Force on the Merit Selection of Judges and co-chair of the Section Annual Meeting. He was also a member of the Advisory Committee on Nominations, the Task Force on State Justice Initiatives, the Special Projects on Expansion of Legal Services Training and Fair Measure, and as co-chair of the Committee on Labor and Employment Relations Law.

The Essex County Bar Association honored Positan with its Professional Achievement Award in April 2001. The New Jersey Commission on Professionalism in the Law bestowed a Professional Lawyer of the Year Award to him in 2002. He was elected a Fellow to the College of Labor and Employment Lawyers as a member of its inaugural class in 1996 and as a Fellow of the American Bar Foundation. He is also a Fellow of the ABA Section of Litigation. He was selected by his peers as one of the “Best Lawyers in America” for labor and employment law, receiving 10-year recognition in the 2003-2004 edition. He was featured in New Jersey Monthly Magazine as one of New Jersey’s Top Lawyers in March, 2003, and as one of the Leading Defense Employment and Labor Lawyers in the 2003-2005 edition of Chambers USA, “America’s Leading Business Lawyers.” He is also listed in Who’s Who in American Law; Who’s Who in America, and Who’s Who in the World.

Positan concentrates his legal practice in the representation of management and defendants in labor and employment matters, including discrimination defense, traditional labor law, non-compete litigation, administrative labor law, and appellate practice.

A graduate of Boston University and New York University School of Law, Positan serves on the Board of Trustees of Montclair State University and the Columbian Foundation, and is a lifetime member of the New Jersey Historical Society. He is also Vice Conseiller Gastronomique of the international wine and food society, La Confrerie de la Chaine des Rotisseurs, Saddle River Valley chapter.

The New Jersey State Bar Association, incorporated in 1899, is dedicated to the continuing education of lawyers and the public, to reforming and improving the legal system and to aiding in the administration of justice.
