Todd's Annual Meeting Blog --- Thursday, May 14th

11:00 AM Military Law and Veterans' Affairs Section Meeting

The MLVAS met and the chair advanced the main point of the meeting, elections by putting the 2009-2010 slate of officers to a vote.

The vote was unanimous for the following:

Chair: Michael Pasquale
Chair-elect: Joan Crowley
Vice Chair: Frank Hoerst
Secretary: Robert Ebberup

The next business tackled was extending appreciation by the chair to the many persons involved, including the many section particpants, the invited speakers including but not limited to Justice Roberto Rivera-Soto, Lieutenant General Jack Rives, and Adjutant General Glenn Reith, and NJSBA and ICLE staff for the April 25th Mililtary Law Symposium held at the Law Center.

The Section then discussed recruitment efforts.

The quote of the meeting came from George Hanley who repeated a favorite saying of one of his professors, "There is no such thing as "good" writing. Only good rewriting."

A broad agenda of outstanding issues was then briefly discussed for the upcoming year.

8:00 AM - Workers' Compensation -- Section 40 Liens/Subrogation and the Implication for Civil Settlements.

Alan Harwick provided a one man program explaining the intent and application of N.J.S.A. 34:15-40 which was enacted by the Legislature to present double recovery of damages by an injured worker where the injuries were the result of the negligence of a third party. In addition, it was enacted to ensure that an injured worker, or his dependents, would be paid all of the benefits required under the Workers Compensation Statute until the worker or his dependents, actually received payment for those same injuries by a third party.

This may seem like a dry tipic, but Harwick kept the subject matter interesting by promoting lively discussion from the audience of judges and attorneys during his presentation.
