Unauthorized Practice Law
The NJSBA's Unlawful Practice Committee reviews and investigates complaints against individuals or entities alleged to be engaging in the unauthorized practice of law, including violations of the bona fide office rule. In doing so, the Committee is guided by Supreme Court Committee opinions, Court Rules and case law to determine if further investigation is warranted. Some matters are then referred to the Supreme Court Committee on the Unauthorized Practice of Law, county, state or federal law enforcement, the Division on Consumer Affairs or other appropriate agencies for further investigation and formal action.
The Committee also informs the Board of Trustees of various issues and trends that may affect the unauthorized practice of law. Issues now under examination include multi-disciplinary practices that would combine lawyers with other professions.
