July 26, 2006 The Appellate Division affirmed the lower court decision.
November 14, 2005 The NJSBA filed its brief in the Appellate Division on November 14, 2005 in the Association’s challenge to the Medical Care Access And Responsibility and Patients First Act, which, among other things, imposes a $75 assessment on attorneys to subsidize medical malpractice insurance premiums.

November 9, 2005 NJSBA appeal scheduled in constitutional challenge to Medical Care Access And Responsibility And Patients First Act.
June 15, 2005 Thomas N. Lyons, P.J. Ch. granted summary judgment to the State in NJSBA v. State, the Association’s challenge to the Medical Care Access And Responsibility and Patients First Act, which, among other things, imposes a $75 assessment on attorneys to subsidize medical malpractice insurance premiums. In making his decision, Judge Lyons concluded the Legislature’s decision to assess attorneys in an effort to address a perceived health care crisis was rational and did not violate attorneys’ constitutional rights.

February 18, 2005 Judge Thomas Lyons denies NJSBA request for injunctive relief put forth in the NJSBA Order to Show Cause in the constitutional challenge to the attorney assessment contained in the New Jersey Medical Care Access and Responsibility and Patients First Act, P.L. 2004, c.17.
January 3, 2005 NJSBA files action against State of New Jersey for attorney assessment to pay physician's insurance premiums.
December 2, 2004 NJSBA sends a Notice to NJSBA Members on the $75 attorney assessment.
November 29, 2004 President McCreedy releases announcement that NJSBA will challenge the constitutionality of the attorney assessment contained in P.L. 2004, c. 17.
July 1, 2004 Letter from President McCreedy to Governor McGreevey calling for the repeal of Section 27 of P.L. 2004, c. 17, New Jersey Medical Care Access and Responsibility and Patients First Act, and for an investigation of insurance industry representatives.
June 23, 2004 Division of Consumer Affairs website containing information about licensing, education, disciplinary action, and medical malpractice court judgments and arbitration awards for New Jersey doctors goes live, www.njdoctorlist.com.
June 9, 2004 Statement from President McCreedy calling for a repeal of the new law in light of the June 7, 2004 order by U.S. District Court Judge William G. Bassler that the Division of Consumer Affairs release information on confidential settlements, jury awards and payouts in medical malpractice cases. The data shows that medical malpractice insurance payouts by physicians have steadily declined since 2001.

June 7, 2004 Press release from President McCreedy expressing outrage on the passage of ACS-50. Governor James E. McGreevy signs the New Jersey Medical Access and Responsibility and Patients First Act despite the objections of the NJSBA. The bill imposes a $75 attorney assessment to bailout high-risk specialty doctors and to reimburse medical students for their student loans.
